The account holder and/or user agrees to indemnify and not hold responsible XY Interact, its directors, employees, contractors or subsidiaries for any claim how so ever arising, including legal fees, from the use of the XY Interact MOBILEmail Service.

The user hereby indemnifies XY Interact, its affiliates, employees, shareholders, agents and service providers against all claims, costs and damages howsoever arising from or in relation to the Customer's breach of these Special Terms and Conditions (including (without limitation)) any fines or penalties imposed on XY Interact by any government or regulatory body; and claims made by third parties howsoever arising from or in relation to the Customer's breach of these Terms and Conditions or the Customer's use of the Services or the Functionality.

XY Interact does not warrant that this service will be error-free or uninterrupted.

The account holder and/or user agrees that XY Interact will not be responsible for any unauthorised access or transmission to or from the account holder's account, or for messages received or not received when using the Service.

The account holder agrees that XY Interact will not be responsible for content sent that from their account infringes on another's rights, including property rights.

XY Interact's liability for negligence or breach of contract with regard to the XY Interact MOBILEmail Service is limited, to the maximum extent permitted by law, to the re supply of XY Interact services or refund of account credit.

This agreement is governed by the law in force in Australia.
